PRIVACY POLICY AND COOKIES OF AIE

This Privacy Policy and Cookies (hereinafter the “Policy“) has the main purpose of regulating the action of processing personal data carried by Artístas, Intérpretes y Ejecutantes, Sociedad de Gestión de España (hereinafter, “AIE“) through “streamrights.media/aie/” (hereinafter “Website“) and establish the conditions for installation of cookies on the user’s browser (hereinafter, the “User“).

This Policy may be complemented by those particular dispositions that could be established to regulate, along the mentioned policy, processes of specific personal data.

1. Processing of personal data
In compliance with the Organic Law 15/1999 on Protection of Personal Data, the personal data collected through questionnaires or any other way related to the Website will be processed by AIE, which has the status of the File Manager. The personal data of Website Users are treated in strict confidentiality and in compliance with the duty of secrecy laid down in Article 10 of Organic Law 15/1999 on Protection of Personal Data.

In addition, personal data obtained through the Website is incorporated into the corresponding file owned by AIE, duly registered in the General Data Protection Registry.

AIE agrees to implement security measures of technical and organizational sort necessary in accordance with the kind of personal data processed, in virtue of Articles 79 and following of the Royal Decree 1720/2007 of 21 December.

2. Purpose
Only personal data that is strictly necessary is requested, in compliance with the principle of data quality and the principles of privacy from design and default of privacy. Personal data collected through the Website is adequate, relevant and not excessive in accordance with the purpose for which it is obtained. AIE does not use illegal, unfair or fraudulent methods to obtain personal data.

The data collection has as main purpose the provision of services of informative nature to Users that if they also have the status of associate, they can access the Virtual Office of AIE to consult additional generic information on the entity or specific information related to their own musical activity. Also, the User expressly consents that the data provided can be used for only sending informational communications related to the activity of AIE, both by email or by any other means.

AIE will request previous consent to the concerned person when the data provided is to be used for a purpose other than that for which it was delivered or requested.

3. Rights ARCO
The User who wishes to exercise rights of access, rectification, cancellation and opposition can do it by writing an email, along with proof of identity, to the email address lopd@aie.es or to AIE headquarters located at Calle Torrelara, 8 (28016) Madrid . Bellow it is explained what each of the rights consist of:

  • Access rights: the User can know what data relating to him/her has AIE, its origin and the purpose for which it is used.
  • Right of rectification: the User can ask AIE to modify any of the personal data, for not being current.
  • Right of cancellation: the Users can request cancellation of their personal data, unless there are reasons to prevent it. Cancellation of data involves blocking before final removal.
  • Right opposition: the User may oppose to the data obtained by AIE from sources different from the own User to be used for certain purposes. Should AIE obtains data from different sources then the User, it will promptly inform the User within 3 months from the start of processing.

AIE will attend such rights within a maximum period of 10 days from the reception, except the right of access that can be processed within a maximum period of 30 days.

4. Acceso a datos personales por terceros
AIE agrees not to assign or communicate personal data to any third party unless explicit authorization of the User.

However, it is possible that AIE may need to allow the access of the User´s personal data to third parties that provides them with certain services. These third parties will have the status of Process Managers, and only the personal data in accordance with the instructions of AIE will be processed in order to carry out the previously arranged provision of services. Under no circumstances the User’s personal data will be use to any other than those detailed in this Policy.

5. Cookies
The Website uses own and third-party cookies that are necessary for the User to enjoy all the functionality of the Website and to track and control the navigation. Cookies are small text files that are installed on the User’s browser and used to register activity on the Website, allowing a more fluid and custom navigation or provide additional features such as viewing videos or interactive graphics, as well as, accessing the User´s private profile.

The User of the Website can set the browser in order to not accept them, block them and, where appropriate, eliminate them. You can also refuse the installation to access the Website, in accordance with Article 22.2 of Law 34/2002 of 11 July, regarding services of society information y and electronic commerce. However, some of the features of this Website require the installation of cookies for the proper functioning so the User´s navigation may be limited if not accepted.
